The following terms of use apply only to the use of and purchases from Baillio's, Inc.'s ("Baillio's") website at www.baillios.com. The terms "you", "your" and "yours" refer to the user/customer utilizing our website to purchase services or merchandise ("Product") or to browse our website. The terms "we", "us" and "our" refer to Baillio's. These terms may not apply to purchases made at our Baillio's retail stores or in any other manner not utilizing the baillios.com website.

Disclaimer of warranty for Baillio's website

We provide our website and its contents on an "AS IS" basis and make no warranty or representation regarding any Product, either express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, which are hereby expressly disclaimed, unless otherwise stated herein.

Errors on our website

Despite our efforts to ensure that the information on our website is accurate, complete and current, there may be instances when information about a Product contains inaccurate or incomplete data, including data about the Product's price or availability. We make no warranty or guarantee that the information on our website is error-free, complete, or current. We reserve the right to correct errors and/or update the content on our website at any time without notice. We also reserve the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

Limitations and exclusions

We reserve the right to change Product pricing, terms, specifications and warranties without notice. In addition, we may revise these terms of use at any time by updating the website. Monitor displays are simulated. Monitors are not included with computer systems unless specified. Online sales are intended for, and limited to, personal use and domestic sales only. We reserve the right to limit the number of Products sold, including the right to prohibit sales to re-sellers. Prices do not include shipping, tax or insurance. We disclaim all responsibility for the accuracy of any map or direction presented on our website.

Damages

In no event shall Baillio's, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives or agents be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of data, use, or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not we have been advised of the possibility of any such damages.

Payment types we accept online

We accept the following forms of payment for your online purchases: MasterCard, Visa, Discover and American Express. For your online purchases, you may purchase multiple products in a single order, and we'll accept one credit card for each order.

We do accept online-only or virtual credit cards as long as they are issued by one of the credit card companies listed above. However, due to the requirements of these companies, these cards can only be used for website orders that are shipped. We do not accept online-only or virtual cards as a form of payment on In-Store Pickup orders.

We are unable to accept cash, checks, C.O.D. orders and wire transfers for any website purchases. If you would like to make a purchase using either cash or a check, please visit your local Baillio's store.

Sales tax policy

We do business primarily in the State of New Mexico and accordingly collect sales and use tax as required by applicable law. Your confirmation of your order total will reflect the applicable state and local sales tax, if any. The tax rate applied to your order will generally be the combined state and local rate for the address where your order was shipped, delivered or picked up.

For any online purchase of a tax-exempt item during a sales tax holiday period, by completing the purchase, you certify that the item is being purchased for personal use only and you agree to assume liability for the applicable tax if the item is used for other than personal use.

Order cancellations

We are unable to refund any online purchase from the time your order is placed (when you click the Submit Order button) until your Product is received by you and returned to us.

Rebates offered by manufacturers

Rebate and coupon offers provided by manufacturers are subject to the terms specified by the manufacturer. These terms may include the timeframe of the offer, limitations on quantities and combination with other offers. Proof of purchase, UPCs from the original packaging and postage are normally required for redemption of rebates by the manufacturer or the manufacturer's agent.
